Terms of Use

The following terms (“Terms of Use”) constitute an agreement between High Performance Ventures, LLC (“HIGH PERFORMANCE VENTURES”), and you that governs your use of this website and all of its associated services, content, and functionality. This policy applies to the websites administered by HIGH PERFORMANCE VENTURES (“Websites”), located at https://www.JairekRobbins.com , https://www.PerformanceCoachUniversity.com , https://www.TheCoreFourChallenge.com

Your use of the Websites constitutes your acceptance of, and agreement to, the following Terms of Use. HIGH PERFORMANCE VENTURES reserves the right to modify, alter, amend or update its Websites, policies and these Terms of Use. These Terms of Use are subject to change without notice. If you do not agree with or do not accept any part of these Terms of Use, you must not use the Websites.

You must be at least 13 years of age or older to purchase the Core Four Program. Children under the age of majority should review this Agreement with their parent or legal guardian.

Purchase Policy

On the Websites, you may purchase physical products, created by HIGH PERFORMANCE VENTURES (the “Physical Products”).

On the Websites, you may purchase downloadable digital products created by High Performance Ventures, including the The Core Four Challenge, More Time Now, The Complete Guide To Activating High Performance (collectively, the “Digital Products”). The Digital Products are delivered in electronic format.

On the Websites, you may enroll for an ongoing membership in the The Core Four Program, which is delivered electronically and billed on a monthly basis (“The Core Four Membership”).

Physical Products, Digital Products, and Core Four Membership are referred to collectively herein as the “Products.”

 

The Core Four Program

On the Websites, you may purchase enrollment in the The Core Four Challenge (“New Client Core Four Program”). This initial purchase of $297 provides you with access to the Core Four Program for four weeks. After the conclusion of the program, you will no longer have access to the portal or the Core Four Program Materials.

You may request a refund for up to 48 hours after your purchase of the Core Four Program.

 

The Core Four Membership

On the Websites, you may purchase enrollment in the Core Four Membership. To enroll in the Core Four Membership, you must first complete the Core Four Challenge Program. The Core Four Membership is a monthly $297 fee. Please note: you must enroll in the Core Four Membership, which is a monthly recurring membership.

After you have enrolled in the Core Four Membership, no refunds will be authorized after the monthly fee has been charged. To avoid incurring additional fees, you must cancel your membership 14 days or more prior to the next billing date. To cancel, email Results@HighPerformanceVentures.com and fill out the cancellation form. This form must be complete to initiate your request. Upon cancellation, your access to the Core Four will be disabled at the expiration of the period for which you have already paid.

 

INTELLECTUAL PROPERTY

You agree that the Core Four Challenge Training Program contains proprietary information and material that is owned by the Company and/or its licensors and is protected by copyright, trademark and other applicable intellectual property laws. Duplicating, sharing or uploading Product files to sharing sites is considered stealing and the Company will prosecute such misconduct to the fullest extent permitted by law.

The Company provides you with the Core Four Challenge Training Program solely for your personal, noncommercial use, and you agree that you will not use such proprietary information or materials in any way whatsoever except for use in compliance with this Agreement. You will not use the Core Four Challenge Training Program or the materials available in the Product in a manner that constitutes an infringement of the Company’s rights or that has not been authorized by the Company. More specifically, unless explicitly authorized in this Agreement, you may not modify, copy, reproduce, republish, upload, post, transmit, rent, lease, loan, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Core Four Challenge Training Program. You may, however, from time to time, download and/or print one copy of individual pages of the Site for your personal, noncommercial use, provided that you keep intact all copyright and other proprietary notices.

To be clear: please be aware that you may not create derivative works, resource guides, marketing or business materials, source material, intellectual property, websites, blogs, web content, or any other works that reference the Company, Jairek Robbins, The Core Four, Performance Coach University, and the program content, or infringe on any of the Company’s intellectual property in any way. Any material that you create should be focused on your business, not ours. All copyrights in and to the Core Four Challenge Training Program (including the compilation of content, postings, links to other internet resources, and descriptions of those resources) are owned by the Company and/or its licensors, who reserve all their rights in law or in equity. THE USE OF THE COMPANY’S CORE FOUR CHALLENGE TRAINING PROGRAM, EXCEPT AS PERMITTED IN THIS AGREEMENT, IS STRICTLY PROHIBITED AND INFRINGES ON THE INTELLECTUAL PROPERTY RIGHTS OF THE COMPANY AND OTHERS AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING POSSIBLE MONETARY DAMAGES, FOR COPYRIGHT AND OTHER INFRINGEMENT.

 

Company trademarks, service marks, graphics, and logos used in connection with the Core Four Challenge Training Program are trademarks or registered trademarks of the Company. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks.

The Core Four Challenge Training Program is an individual purchase program. Upon registration you will receive one username, password, and a member profile for use during the live course and in the private member site as well as the exclusive directory listing.

If you would like to take Core Four Challenge along with a business partner or collaborator, you will need to each purchase the course individually. Additionally, if you are interested in having your assistant or your entire team take Performance Coach University, a separate membership will need to be purchased for each participating member.

 

PRIVACY AND CONFIDENTIALITY

The Core Four Challenge Training Program is subject to the Company’s Privacy Policy. The Company does not knowingly collect personal information from children under the age of 13 and does not wish to do so. The Company reserves the right to request proof of age so that it can verify that minors under the age of 13 are not using the Core Four Challenge Training Program.

We respect your privacy and must insist that you respect the privacy of other people that participate in the Program (“Core Four Challenge Training Participants” or “Program Participants”). Thus, consider this a mutual non-disclosure agreement.

We respect your confidential and proprietary information, ideas, plans and trade secrets (collectively, “Confidential Information”) and by purchasing this program you agree to respect the same rights of Core Four Challenge Participants, the Core Four Challenge Program and representatives of the Company.

Thus, you agree:

• not to infringe on any copyright, patent, trademark, trade secret or other intellectual property rights of the Company and the Program Participants.
• that any confidential information shared by Core Four Challenge Participants or any of the Company’s representatives is confidential and proprietary and belongs solely and exclusively to the Participant who discloses it or to the Company.
• not to disclose such information to any other person or use it in any manner other than in discussion with other Core Four Challenge Participants during training sessions.
• that all materials and information provided to you by the Company are the Company’s confidential and proprietary information and intellectual property, belong solely and exclusively to the Company, and may only be used by you as authorized by the Company.
• the reproduction, distribution and sale of these materials by anyone but the Company is strictly prohibited.
• that if you violate, or threaten to violate, any of your agreements contained in this paragraph we will be entitled to, among other things, injunctive relief to prohibit such violations.

 

While you are free to discuss your personal results from our programs and training, you must keep the experience and statements, oral or written, of all other participants in the strictest of confidence.

 

CORE FOUR CHALLENGE MEMBER AREA AND COMMUNITY RULES

• No Solicitation Within the Core Four Challenge Member Area. The Core Four Challenge community is about learning how to get and server your team, clients and customers, and is not about trying to turn other Core Four Challenge Participants into your customers. You are not permitted to offer your services, sell your programs or products, nor are you permitted to invite Core Four Challenge Participants to join other social networks, groups, or programs. This is a space for learning and is a pitch-free, solicitation-free and sales-free environment. Sharing affiliate links within the Member Area is not permitted. Your failure to comply with these terms will result in immediate termination of your participation in the Core Four Challenge Program without refund.
• Core Four Challenge Community Rules. You agree to abide by the Core Four Challenge Community Rules, which are available at community guidelines, section 2. COMMUNITY GUIDELINES.

 

THIRD-PARTY MATERIALS AND WEBSITES

The Company may provide links to third-party materials and websites and establish a Facebook group as a convenience to you and other Core Four Challenge Participants. These third-party materials and websites are not part of the Core Four Challenge Program and they may be either withdrawn or terminated at any time without any liability on the part of the Company. You agree that you will be responsible for all payment and other obligations associated with your use of any and all third-party materials and websites. In addition, you agree that the Company is not responsible for examining and evaluating the content and accuracy of any third-party materials and websites, and the Company does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. You further agree that you will not use any third-party materials and websites in a manner that would infringe or violate the rights of any other party and that the Company will not be liable for your improper use of third-party materials and websites.

 

Refund Policy

You may request a refund for a Digital Product within 48 hours of purchase. After that, no refunds are available. Please note that this includes the Core Four Challenge Program.

Additionally, you may not defer your participation in the Core Four Program. Your purchase is good only for participation in the round of the Core Four Challenge Program that you purchased. If you are unable to participate in that round, you will need to purchase a space in a future round.

The Core Four Membership may be canceled at any time. Upon cancellation, your member account will be disabled at the expiration of the period for which you have already paid. The Websites do not offer refunds after the monthly fee has been charged. You may avoid incurring additional fees by canceling your Core Four Membership 14 days or more prior to the billing date.

We will accept your return of unworn, unwashed, and defective merchandise by mail.

Email: Support@PerformanceCoachUniversity.com (subject line: Return Core Four) to obtain a Return Authorization Number within 14 days of the order date.

• Place the products inside a shipping envelope and mail it the following address:

• Return shipping will not be refunded.
• Write the Return Authorization Number clearly and visibly on the outside of your returned package. Returns that do not have a Return Authorization Number written on the outside of the package will not be opened and will be returned to sender (at sender’s expense).
• Purchases that meet the above return policy guidelines will be refunded back to the original method of payment.
• Purchases received outside of the Return Policy Guidelines will not be mailed back and will not be refunded.

We will credit you for returns received within 14 days of the purchase for the price paid to the original form of payment.

License For Use Of Products

All Products available for sale on the Websites, including Digital Products, were developed solely for your personal use and may not be reproduced for publication or for the personal or commercial use of others without permission. This includes all resources provided within the Products, such as meal plans, challenges, or workouts.

Your Membership And Access To The Core Four Program Materials

To access the Core Four Challenge or The Core Four Challenge Membership, you will receive a login to the Performance Coach University / The Core Four Challenge Portal via email. This login is personal to you only. Sharing your login information is strictly prohibited.

Please note that your purchase is not for lifetime access to the materials from the Core Four Challenge or the Core Four Membership. Upon conclusion of the Core Four Challenge, your access to the Core Four Challenge materials and portal will be revoked. Your access to the Core Four Membership Program will be revoked upon the expiration of the period for which you have already paid.

 

PAYMENT POLICY

You are responsible to pay for the Core Four Challenge Training Program in full (including all applicable sales and other taxes or fees) and for providing us with a valid credit card or other payment method. If you have selected a payment plan and you miss a payment, your account status will be changed to “delinquent.” You will immediately lose access to future Modules and Bonuses and your access to all Core Four Challenge content will be revoked 7 days after your payment declines. You will also not receive access to future versions of the Program as it’s released until all payments are made in full.

If your account remains in delinquent status for longer than 60 days, the Company reserves the right to report any delinquent balance owed to a credit reporting bureau and/or collections agency subject to the Company’s sole discretion until the account is caught up and in good standing.

To be clear, Core Four Challenge is not a “pay in part” program where you can pay only for access to certain Modules and not others. This is a full immersion program and your payment plan is a convenience that we offer so that you can make the price sustainable.

 

Your Responsibility

The Websites were developed strictly for informational purposes. You understand and agree that you are fully responsible for your use of the information provided on the Websites. HIGH PERFORMANCE VENTURES makes no representations, warranties or guarantees. You understand that results may vary from person to person. HIGH PERFORMANCE VENTURES assumes no responsibility for errors or omissions that may appear in the Websites.

EARNINGS DISCLAIMER

When addressing financial matters in any of our websites, videos, newsletters, programs or other content, we’ve taken every effort to ensure that we accurately represent our programs and their ability to grow your business and improve your life. However, the Company does not guarantee that you will get any results or earn any money using any of our ideas, tools, strategies or recommendations, and nothing on our Sites is a promise or guarantee to you of future earnings.

YOU EXPRESSLY AGREE THAT YOUR USE OR INABILITY TO USE THE CORE FOUR CHALLENGE TRAINING PROGRAM IS AT YOUR SOLE RISK. By purchasing the Core Four Challenge Training Program, you accept, agree and understand that you are fully responsible for your progress and results from your participation and that we offer no representations, warranties or guarantees verbally or in writing regarding your earnings, business profit, marketing performance, audience growth or results of any kind. You alone are responsible for your actions and results in life and business which are dependent on personal factors including, but not necessarily limited to, your skill, knowledge, ability, dedication, business savvy, network and financial situation, to name just a few. You also understand that any testimonials or endorsements by our customers or audience represented on our programs, websites, content, landing pages, sales pages or offerings have not been scientifically evaluated by us and the results experienced by individuals may vary significantly. Any statements outlined on our websites, programs, content and offerings are simply our opinion and thus are not guarantees or promises of actual performance. We offer no professional legal, medical, psychological or financial advice.

 

Use Of The Websites

Unless otherwise stated, HIGH PERFORMANCE VENTURES owns the intellectual property and rights to all content and material on the Websites. Subject to the license below, all intellectual property rights are reserved.

You may view, download (for caching purposes only), and print pages for your personal use, subject to the restrictions set out below and elsewhere in these Terms of Use.

The following uses are not permitted:

• Republication of content from the Websites, unless content is specifically and expressly made available for republication;
• Sale, rental or sub-license of any content from the Websites;
• Reproduction or duplication of any content on the Websites for commercial purposes;
• Modification of any content on the Websites, unless content is specifically and expressly made available for modification;
• Redistribution of content of the Websites, unless content is specifically and expressly made available for redistribution. Users are permitted to share content on social media channels, as long as a link to the Websites is included.

From time to time, the Websites will utilize various plugins or widgets to allow sharing of content via social media channels, email or other methods. Use of these plugins or widgets does not constitute any waiver of HIGH PERFORMANCE VENTURES’s intellectual property rights. Such use is a limited license to republish the content on the approved social media channels, with full credit to HIGH PERFORMANCE VENTURES.

You must not use the Websites in a way that causes, or may cause, damage to the Websites or impair the availability of access to the Websites. You must not decompile, reverse engineer, disassemble or otherwise reduce the Websites, except to the extent that such activity is expressly permitted by applicable law. You must not use the Websites to copy, store, host, transmit, send, use, publish or distribute any material that consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit and/or other harmful code or malicious software.

You must not conduct any systematic or automated data collection activities, including, but not limited to scraping, data mining, data extraction or data harvesting on or in relation to the Websites without HIGH PERFORMANCE VENTURES’s express written permission.

You must not use the Websites to transmit or send any unsolicited commercial communications.

You must not use the Websites for any third-party marketing without HIGH PERFORMANCE VENTURES’s express written permission.

Unless otherwise noted, the design, content and all components of the Websites are copyrights owned by HIGH PERFORMANCE VENTURES or third parties and are protected by United States and international copyright laws and should not be reused or republished without express written permission.

Trademarks

HIGH PERFORMANCE VENTURES’s trademarks and trade dress may not be used in connection with any product or service that is not HIGH PERFORMANCE VENTURES’s, in any manner likely to cause confusion among consumers, or in any manner that disparages or discredits HIGH PERFORMANCE VENTURES, the Core Four Challenge, The Core Four Membership, Jairek Robbins, or Amanda Robbins.

From time to time, the Websites will legally utilize trademarks owned by third parties related to HIGH PERFORMANCE VENTURES’s services. These trademarks are the respective property of their owners.

Grant Of Rights

You grant HIGH PERFORMANCE VENTURES a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute any content you contribute to the Websites. This includes, but is not limited to, text, images, audio material, comments, video material and audio-visual material. This license extends to all known and future media. You also grant HIGH PERFORMANCE VENTURES the right to sub-license these rights and the right to bring an action for infringement of these rights.

Content Contributed To The Websites

Any content you contribute to the site, including, but not limited to text, images, audio material, comments, video material and audio-visual material, must not be illegal or unlawful, may not infringe on any third-party’s legal rights, and must not be capable of giving rise to legal action whether against you or HIGH PERFORMANCE VENTURES or a third party.

HIGH PERFORMANCE VENTURES reserves the right to edit or remove: (i) any material submitted to the Websites; (ii) stored on HIGH PERFORMANCE VENTURES’s servers; or, (iii) hosted or published on the Websites. HIGH PERFORMANCE VENTURES takes no responsibility and assumes no liability for any content posted by you or any third party.

Notwithstanding HIGH PERFORMANCE VENTURES’s rights under the Terms of Use, HIGH PERFORMANCE VENTURES does not undertake to monitor the submission of all content to, or the publication of such content on, the Websites.

Comment Policy

The Websites offer the option for you to leave comments, engaging with the Websites’ posts. The following types of comments will not be tolerated and will be deleted:

• harassment directed toward any content creator or HIGH PERFORMANCE VENTURES;

• hate speech;
• defamatory to HIGH PERFORMANCE VENTURES or any third party;
• reference illegal acts; or,
• violate the legal rights of a third party.

HIGH PERFORMANCE VENTURES’s sole discretion will be used to determine if a comment is in violation of this comment policy. Any comments in violation will be promptly deleted and no further explanation will be due to you if your comment was determined to be in violation with this policy.

Membership Policy

The Websites offer the Core Four Challenge Membership, which includes forums, such as Facebook Groups, where content may be contributed or uploaded. The following types of contributions will not be tolerated and will be deleted:

HIGH PERFORMANCE VENTURES’s sole discretion will be used to determine if a member is in violation of these policies. Any members in violation will be promptly deleted and no refund will be due.

Communication

If you send HIGH PERFORMANCE VENTURES an email, register to use the Websites or provide your email to HIGH PERFORMANCE VENTURES in any other way, you consent to receive communications from HIGH PERFORMANCE VENTURES electronically. You agree that all legal notices provided via electronic means from HIGH PERFORMANCE VENTURES satisfy any requirement for written notice.

Third Parties

The Websites contain links to third-party websites that are not governed or controlled by HIGH PERFORMANCE VENTURES. You represent and warrant that you have read and agree to be bound by all applicable Terms of Use and policies for any third-party website that relates to your use of the Websites. HIGH PERFORMANCE VENTURES assumes no control or liability over the content of any third-party sites. You expressly hold harmless HIGH PERFORMANCE VENTURES from any and all liability related to your use of a third-party website.

Prior to engaging in any events or commercial transactions with any third parties discovered through or linked on the Websites, you must complete any necessary investigation or due diligence. If there is a dispute for any events or commercial transactions with a third party discovered through or linked on the Websites, you expressly hold HIGH PERFORMANCE VENTURES harmless from any and all liability in any dispute.

No Warranties

The Websites are provided on an “as is” and “as available” basis without any representations or warranties, expressed or implied. HIGH PERFORMANCE VENTURES makes no representations or warranties in relation to the Websites or the information and materials provided therein.

HIGH PERFORMANCE VENTURES makes no warranty the Websites will meet your requirements; will be available uninterrupted; timely and free of viruses or bugs; or represents the full functionality, accuracy, and reliability of the Websites. HIGH PERFORMANCE VENTURES is not responsible to you for the loss of any content or material uploaded or transmitted through the Websites. The Websites are written in English and makes no warranty regarding translation or interpretation of content in any language.

Limitation Of Liability

HIGH PERFORMANCE VENTURES WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, PUNITIVE OR SPECIAL DAMAGES OF ANY KIND, HOWEVER CAUSED, INCLUDING LOSS OF PROFITS, REVENUE, DATA OR USE, INCURRED BY YOU, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY OR OTHERWISE, EVEN IF THE OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnity

You agree to defend, indemnify and hold HIGH PERFORMANCE VENTURES, its members, employees, officers, directors, managers and agents harmless from and against any and all losses, claims, suits, actions, liabilities, obligations, costs and expenses (including reasonable attorneys’ fees and expenses) which HIGH PERFORMANCE VENTURES suffers as a result of third-party claims based on: (i) your negligence or intentional misconduct, (ii) your breach of any provision of the Terms of Use (including representation or warranty); (iii) materials prepared or provided by you including, but not limited to, any claims of infringement, or misappropriation of copyright, trademark, patent, trade secret, or other intellectual property or proprietary right, infringement of the rights of privacy or publicity, or defamation or libel; or (iv) death, personal injury, or property damage arising out of, or relating to, your obligations hereunder.

 

NON-DISPARAGEMENT.

You agree that you will not engage in any conduct or communications with a third party, public or private, designed to disparage the Company, Performance Coach University, The Core Four Challenge, Amanda Robbins or Jairek Robbins including but not limited to any remark, comment, message, information, declaration, campaign, communication or other statement of any kind, whether verbal, in writing, electronically transferred or otherwise, that might reasonably be construed to be derogatory, defamatory, libelous or slander.

Arbitration

The Terms of Use will be governed and construed in accordance with the laws of the Puerto Rico. Any controversy or claim arising out of or relating to the Terms of Use, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of any such arbitration shall be in or near Mayaguez, Puerto Rico. The parties also agree that the AAA Optional Rules for Emergency Measures of Protection shall apply to the proceedings.

Miscellaneous Provisions

If any provision(s) of the Terms of Use is held to be invalid, illegal or unenforceable, the remaining provisions shall be severable and enforceable. If a provision is excessively broad, such a provision shall be limited or reduced in scope so as to be enforceable.

The Terms of Use may not be assigned by you without HIGH PERFORMANCE VENTURES’s prior written consent; however, the Terms of Use may be assigned by HIGH PERFORMANCE VENTURES in its sole discretion.

The Terms of Use are the final, complete and exclusive agreement of the parties with respect to the Websites offered by HIGH PERFORMANCE VENTURES.

All notices with respect to the Terms of Use must be in writing and may be via email to Support@PerformanceCoachUniversity.com for HIGH PERFORMANCE VENTURES and to your email address.
